Guidelines for Application of Drone Operation Flights for Category Under 250 Grams


Compliance Requirements Before Application

1. Applicants can obtain complete relevant information on the official website of the Sabah Chief Minister's Department (JKM).
2. Registration for the drone category below 250 grams is only open for hobby and recreational activities only. The use of drones for other activities such as agriculture, mapping, maintenance and so on is not allowed.
3. Registration for the category of drones under 250 grams is only open to local drone operators (Malaysian citizens) aged 18 years and above only.
4. In order to obtain an Operator ID (permission to fly a drone), individuals who have completed registration need to take an online exam for free on the official website of the Sabah Chief Minister's Department (JKM).
5. This online exam contains 40 objective questions. Participants need to achieve a 100% passing score to qualify for an Operator ID to be issued.
6. Participants are allowed to sit this test repeatedly until they successfully obtain an overall score of 100%.
7. Drones that are registered must consist of a list of manufacturers/types of drones that have obtained recognition from SIRIM (Standard and Industrial Research Institute of Malaysia) & MCMC (Malaysian Communications and Multimedia Commission). For the trial period, only 13 types of drones weighing below 250 grams can be registered. (Refer to the list of approved drones below).
8. Drone operators are encouraged to take third party liability insurance.
9. Fines or penalties will be imposed according to the rules issued by the Civil Aviation Authority of Malaysia (CAAM) if the drone operator (operator) is found to have violated the rules that have been set.
 - Company : A fine of RM100,000 or 3 years imprisonment, or both.
 - Individual : A fine of RM50,000 or 3 years imprisonment, or both.

Compliance Requirements During Flight

1. Drones that are flown must use the Visual Line of Sight (VLOS ) method (parameters within 300 meters ).
2. The height distance of the flown drone is not more than 30 meters (100 feet) from the ground.
3. Drones that are flown are NOT used to carry any dangerous goods as follows:
 a. Explosives
 b. Flammable solids
 c. Flammable liquids
 d. Oxidizing agents and organic peroxides
 e. Toxic and infectious substances
 f. Radioactive material
 g. Corrosive substances
 h. Various hazardous materials and articles, including materials hazardous to the environment

4. Drones flown should also NOT be used to drop any items for the purpose of advertising, promotion, propaganda, and so on.
5. Drones should NOT be flown over assembly areas or public gatherings.
6. The drones used should NOT be modified in terms of their physical appearance, speed, battery life and so on.
7. The maximum allowed speed of the drone is not more than 19 m/s.
8. As an additional safety measure, every drone operator must have an assistant when flying the drone in the field.
9. Drone flights are permitted at night, provided that established procedures are followed. Night flying activities must be conducted within the parameters of the controlled area. Drone pilots flying at night must ensure that the flights are conducted safely, without endangering the crew, assets, civilians, or property.

10. The drone operator must ensure that he is NOT under the influence of alcohol or drugs while operating the drone in the field.
11. Each drone flight will be monitored by the regulatory agencies involved.
12. Drone operators are only allowed to fly drones in areas designated by JKM Sabah. (Refer to the list of specific locations below).

Post-Flight Compliance Requirements

1. In order to protect personal information and public privacy, any images or videos that are intended to be used as a result of drone flights must undergo a screening process and obtain permission from the individuals involved to comply with personal information and privacy safety concerns.

2. If the drone operator discovers that the drone used has been lost, damaged, or wishes to sell it to another owner, the cancellation of registration must be done first online through the website of the Chief Minister Department of Sabah (JKM). Failure to do so will result in a high safety risk if any violations occur by the new owner.

3. If the registered drone is sold to someone else, you need to cancel the registration of the drone that has been made. This is to ensure that the responsibility for the respective drone has been transferred to the new owner.
